Terms of Service for PhoneTea

1. Acceptance of Terms
By accessing or using the PhoneTea mobile application (“App”), website, or services (collectively, “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Services.
2. Description of Service
PhoneTea is a phone number review and lookup platform that allows users to:
- Search for phone numbers and view associated reviews
- Submit reviews for phone numbers
- Verify ownership of phone numbers
- Access premium features through subscription
- Use API services (for approved developers)
- Send end-to-end encrypted direct messages to other users
- Create and participate in encrypted group chats
- Message reviewers about phone numbers
3. User Accounts
3.1 Account Creation
- You must be at least 13 years old to use our Services
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account
- You are responsible for all activities under your account
3.2 Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Provide false information
- Engage in fraudulent activity
- Abuse the Services or other users
- Violate applicable laws
4. User Content and Conduct
4.1 User Reviews
When submitting reviews, you agree:
- Content must be truthful and based on personal experience
- You will not submit spam, advertisements, or promotional content
- You will not include personal information (except phone numbers)
- You will not include offensive, defamatory, or illegal content
- You will not manipulate reviews
4.2 Prohibited Content
You may not submit content that:
- Contains hate speech, threats, or targeted harassment toward individuals or groups
- Uses extreme or abusive language intended to intimidate or insult others
- Violates intellectual property rights
- Contains malware or malicious code
- Solicits personal information from minors
- Promotes illegal activities
- Contains explicit sexual content
- Violates privacy rights of others
4.3 Content Moderation
- We reserve the right to review, edit, or remove any content
- Reviews are automatically screened at submission for personal information
and prohibited content; flagged content may be hidden pending review by
our moderation team
- Personal information included in a review in violation of Section 4.1 may
be hidden or removed, and repeated violations may result in account
suspension
4.4 Review Disputes
If you are the verified owner of a phone number, you may dispute reviews
about that number through the in-app dispute feature. Reviews alleging the
exposure of personal information or doxxing may be hidden pending review.
Our moderators make the final determination on whether disputed content is
removed or restored. If you cannot verify ownership of a number, you may
still flag a review using the available reporting options. Filing knowingly
false disputes or reports may result in loss of verification or account
action.
5. Phone Number Verification and SMS Codes
5.1 Claim This Number Verification
Users may choose to verify ownership of a phone number listed on PhoneTea by using the “Claim This Number” feature. Verification is optional, but it is required to manage a number profile, respond to reviews for that number, or receive a verified badge.
5.2 One-Time SMS Verification Codes
When a user taps “Send Code” in the PhoneTea app, PhoneTea may send a one-time SMS verification code to the phone number being claimed. This SMS is used only to confirm that the user has access to the phone number.
PhoneTea does not send marketing, promotional messages, recurring alerts, or unsolicited SMS messages through this verification flow. SMS verification codes are transactional and user-initiated.
5.3 Consent and Message Charges
Before any verification SMS is sent, users are shown an in-app disclosure explaining that tapping “Send Code” means they consent to receive a one-time SMS verification message. Message and data rates may apply.
5.4 Verification Code Expiration and Limits
Verification codes are temporary and may expire after a short period. Rate limits may apply to prevent fraud, abuse, and repeated verification attempts.
5.5 Verified Numbers
Verified numbers may display a verification badge. You must be the actual owner or authorized user of the phone number you claim. False verification claims, fraudulent claims, or attempts to claim numbers without authorization may result in removal of verification, account suspension, or account termination.
5.6 Contact Import (Optional)
PhoneTea offers an optional feature, available on mobile devices, that lets you import contacts from your device's address book into your private "safe caller" whitelist. This feature is entirely optional and the app is fully functional without it.
If you use contact import, you represent that you have a legitimate basis to import the contact information into the app for your own personal use. Imported contacts are stored only in your private whitelist, are visible only to you, and are not shared with other users or used to send marketing. You may revoke the contacts permission at any time through your device settings, and you may remove imported entries from your whitelist within the app.
6. Intellectual Property
6.1 Our Rights
- All content, features, and functionality are owned by PhoneTea
- Our trademarks, logos, and service marks are protected
- You may not use our intellectual property without permission
6.2 Your Rights
- You retain ownership of content you submit
- You grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content
- This license continues even after account termination
7. Subscription Types and Premium Services
7.1 Consumer Subscriptions (In-App Purchase)
Our Premium subscription plans (Monthly, Yearly, Lifetime) are available for purchase within our mobile applications via Apple App Store or Google Play Store in-app purchases. These subscriptions provide enhanced app features including unlimited searches, ad-free experience, and included API calls for personal use.
Subscription Plans:
- Monthly Pro: $9.99/month (Web), $12.99/month (iOS/Android)
- Yearly Pro: $99.99/year (Web), $124.99/year (iOS/Android)
- Lifetime Pro: $499.99 (one-time, Web only)
- Ad-Free Only: $2.99/month (Web), $3.99/month (iOS/Android)
7.2 Developer API Subscriptions (Web Only)
Our API subscription plans are professional business-to-business (B2B) services designed for developers and enterprises requiring programmatic access to our phone number database. These subscriptions:
- Must be purchased through our web platform at phonetea.com
- Are not available via in-app purchase
- Are separate from consumer app subscriptions
- Include professional developer tools and API keys
- Are intended for business/commercial integration purposes
API subscriptions are processed through Stripe and are subject to separate terms and conditions.
7.3 Relationship Between Premium and API Subscriptions
Consumer Premium subscriptions and Developer API subscriptions are billed independently with separate billing cycles. However, an active Premium subscription is required to purchase or renew API subscriptions.
Cancellation: Cancelling a subscription stops future charges but does not revoke paid time. Premium app features remain fully active until the end of your current Premium billing period. API subscriptions cancelled by you remain fully active until the end of the current API billing period, during which you may reactivate the subscription to resume normal renewals. If your Premium subscription ends while you have an active API subscription, your API access continues until the end of your current API billing period; once that period ends, API access is revoked until Premium is renewed.
Refund: If your Premium subscription is refunded, all access is revoked immediately — including any active API subscription. API keys are deactivated and API access is terminated at the time of refund processing, regardless of remaining API billing time.
API Subscription Changes: Cancellation, suspension, or modification of your API subscription does not affect your Premium app features.
7.4 Payment Terms
- Subscriptions auto-renew unless canceled
- Cancellation takes effect at the end of the current billing period; you retain full access until then
- For subscriptions billed through app stores, cancellation must be completed at least 24 hours before renewal

- Pricing may change with 30 days notice
- Lifetime subscriptions are one-time purchases with no renewal
7.5 Premium App Features
Premium users receive:
- Up to 3,000 searches per month (varies by tier)
- Ad-free experience
- Priority support
- Advanced analytics
- AI summary access (up to 3,000 per month, varies by tier)
- Included API calls (see Section 9.2)
- Early access to new features
- Enhanced messaging limits:
- Unlimited daily messages (free: 200/day)
- Unlimited new conversations (free: 10/day)
- Up to 256 group members (free: 50)
- 20 groups created per day (free: 2)
- Shadow Chat with 1h, 24h, 7d, 30d auto-delete timers
- Disappearing photos (24h auto-delete)
- Priority message delivery
- Up to 10 photos per message (free: 5)
- File sharing in chats
- Unlimited message history (free: 90 days)
- Full chat search history (free: last 150 messages)
7.6 Limited Availability Plans
Certain promotional plans (including Lifetime Pro) may be:
- Limited to a fixed number of users
- Available only during specific promotional periods
- Subject to closure at our discretion
Once closed, existing users retain their benefits under the terms at time of purchase (“Grandfathered Users”). Grandfathered Users are subject to fair use policies and may have different feature limits than subscribers who purchased under later terms.
7.7 Service Modifications
We may modify, suspend, or discontinue features with notice:
- 30 days notice for minor changes
- 90 days notice for material changes affecting paid features
- Lifetime users will be offered reasonable accommodations if core features are materially reduced
8. Business Verification
8.1 Verification Process
- Businesses may apply for verified status
- Verification requires proof of business ownership
- We reserve the right to approve or deny applications
- Verification may be revoked for policy violations
8.2 Business Features
Verified businesses may:
- Claim phone numbers
- Respond to reviews
- Display business information
- Access analytics dashboard
- Receive discounts on API subscriptions
9. API Access and Usage
9.1 API Terms
- API access is included with Premium subscriptions for personal use
- Higher volume API access requires Developer API subscription
- Rate limits apply based on subscription tier
- API access is a privilege, not a guaranteed right
- Abuse may result in API key revocation
9.2 API Usage Limits (Included with Premium)
- Free tier: No API access
- Monthly Pro: 500 calls/month
- Yearly Pro: 1,000 calls/month
- Lifetime Pro: 2,500 calls/month
9.3 Developer API Subscriptions (Additional)
Users requiring higher API limits may purchase separate Developer API subscriptions through our web platform:
- Pay-As-You-Go: Metered billing per API call
- Starter: 5,000 calls/month - $29/month
- Professional: 20,000 calls/month - $79/month
- Business: 75,000 calls/month - $199/month
- Enterprise: 250,000 calls/month - $499/month
9.4 API Rate Limit Enforcement
API calls exceeding monthly limits will receive HTTP 429 responses. Limits reset on the 1st of each month at 00:00 UTC. Response headers include current usage information.
9.5 Acceptable Use Policy
Users with API access (including free API calls included with Premium subscriptions) agree to use the API only for:
- Personal or business integration purposes
- Legitimate phone number verification and lookup
- Compliance with all applicable laws and regulations
- Non-competitive use (not building competing services)
9.6 Prohibited API Activities
The following are strictly prohibited:
- Reselling or redistributing API data to third parties
- Excessive or abusive request patterns (scraping, bulk downloading)
- Circumventing rate limits or security measures
- Using API access for illegal purposes
- Sharing API keys with third parties
- Creating tools that enable ToS violations by others
- Automated data harvesting beyond reasonable use
- Using the API to build competing products or services
- Reverse engineering our systems or algorithms
9.7 Enforcement of API Terms
We reserve the right to:
- Issue warnings for first-time or minor violations
- Reduce API rate limits or monthly quotas
- Temporarily suspend API access (7-30 days)
- Permanently terminate API access
- Revoke API keys without notice for severe violations
- Investigate suspicious usage patterns
- Report illegal activity to appropriate authorities
IMPORTANT: Violations of API terms may result in suspension or termination of API access while maintaining your Premium subscription for app features (searches, ad-free experience, etc.). API access penalties do not entitle you to a refund of your Premium subscription.
9.8 Premium and API Access Relationship
Premium subscriptions grant access to enhanced app features. API access (including free API calls) is a separate privilege subject to our API Terms, but requires an active Premium subscription as a prerequisite.
Grace Period: If your Premium subscription expires or is cancelled while you have a paid API subscription with remaining time, your API access continues until the end of your current API billing period. This grace period does not apply to Premium refunds, which revoke all access immediately.
Lifetime Premium subscribers retain access to app features (unlimited searches, ad-free experience, priority support) but may lose API privileges for violations. Loss of API privileges does not affect other Premium benefits and does not entitle you to any refund.
9.9 Graduated Enforcement
API violations are handled through a graduated enforcement system:
- Warning (First Offense): Email notification describing the violation and expected behavior changes.
- Rate Limit Reduction (Second Offense within 90 days): Monthly API quota reduced for 30 days.
- Temporary Suspension (Third Offense within 180 days): API access suspended for 7-30 days.
- Permanent Termination (Fourth Offense or Severe Violation): API access permanently revoked while Premium app features remain active.
- Account Termination (Extreme Cases): Full account termination for illegal activity, fraud, or repeated severe violations.
9.10 Appeals Process
Users whose API access has been reduced, suspended, or terminated may appeal by contacting phonetea.app@gmail.com with:
- Account email address
- Description of your use case
- Explanation of the activity that triggered enforcement
- Commitment to comply with API terms going forward
We will review appeals within 5 business days. Appeals for permanent terminations will be reviewed by a senior team member. Some decisions (particularly those involving illegal activity) are final and not appealable.
10. Messaging Services
10.1 Overview
PhoneTea provides end-to-end encrypted messaging services that allow users to:
- Send private direct messages to other PhoneTea users
- Create and participate in encrypted group chats (up to 256 members)
- Message reviewers about their experiences with phone numbers
- Communicate with verified phone number owners
10.2 End-to-End Encryption
- All messages are encrypted using AES-256 encryption
- Encryption keys are generated locally on your device
- PhoneTea cannot read the content of your encrypted messages
- Group encryption keys are rotated when members leave a group
- Encryption does not apply to message metadata (sender, timestamp, etc.)
10.3 Account Requirements
- You must have a verified PhoneTea account to use messaging
- You must be logged in to send or receive messages
- Your username will be visible to message recipients
- Your account must be in good standing (not suspended or banned)
10.4 Message Conduct
When using messaging services, you agree to NOT:
- Send spam, unsolicited advertisements, or promotional content
- Harass, threaten, or intimidate other users
- Send content that violates our Prohibited Content guidelines (Section 4.2)
- Impersonate other users or PhoneTea staff
- Share malware, phishing links, or malicious content
- Solicit personal information from minors
- Use messaging for illegal activities
- Circumvent user blocks or restrictions
- Send excessive messages (rate limits apply)
10.5 Group Chat Rules
10.5.1 Group Creation
- Any user can create a group chat
- The creator becomes the group “Owner”
- Owners can promote members to Admin or Moderator roles
- Group names and descriptions must follow content guidelines

10.5.3 Group Ownership Transfer
- Owners can transfer ownership to another member
- If an Owner leaves without transferring, ownership transfers to the longest-standing Admin
- If no Admins exist, ownership transfers to the longest-standing member
10.6 Message Retention and Deletion
- Messages are stored on our servers in encrypted form
- You can delete your own messages at any time
- Deleting a message removes it for all participants (“delete for everyone”)
- Deleted messages cannot be recovered
- Group messages may remain visible to other members even if your account is deleted
- We may retain message metadata for security and legal compliance
10.7 Blocking and Reporting
- You can block any user from messaging you
- Blocked users cannot send you direct messages
- Blocked users cannot add you to group chats
- You can report inappropriate messages to our moderation team
- Reports include message content (decrypted for review) and context
- False or malicious reports may result in account penalties
10.8 Rate Limits
To prevent abuse, messaging is subject to rate limits:
- Direct messages: 100 messages per hour per conversation
- Group messages: 50 messages per hour per group
- New conversations: 10 new conversations per day
- Group creation: 2 new groups per day
- Violations may result in temporary messaging restrictions
10.9 Premium Messaging Features
Premium subscribers receive enhanced messaging features:
- Higher rate limits (unlimited daily messages vs 200/day)
- Priority message delivery
- Larger group sizes (Premium: 256 members, Free: 50 members)
- Extended message history (free: 90 days, Premium: unlimited)
10.10 Disclaimers
- We do not guarantee message delivery
- Messages may be delayed due to network conditions
- We are not responsible for content sent by users
- Encryption protects message content but not metadata
- Screen captures and external sharing are user responsibilities
- We cannot prevent recipients from sharing message content
10.11 Law Enforcement and Legal Requests
- We comply with valid legal requests
- Encrypted message content cannot be provided (we don’t have decryption keys)
- Message metadata may be provided when legally required
- We will notify users of requests unless legally prohibited

10.12 Termination of Messaging Access
We may suspend or terminate your messaging access if you:
- Violate these messaging terms
- Send spam or unsolicited messages
- Harass or threaten other users
- Use messaging for illegal purposes
- Attempt to circumvent our security measures
- Abuse the reporting system
11. Caller ID and Call Screening Services
11.1 Service Description
PhoneTea provides Caller ID and call screening services ("Caller ID Services") that identify incoming calls and provide spam detection information. These services are available on Android (10+) and iOS (13+) platforms.
Features include:
- Real-time spam detection and call screening
- Business name identification (Reverse Lookup)
- Caller ID labels and risk assessment
- Whitelisted contact management
- Call blocking recommendations
- Voicemail transcription services
- Call recording capabilities (where legal)
- Time-based blocking schedules
- Spam analytics and reporting
11.2 Platform-Specific Limitations
Android:
- Automatic call screening on Android 10+ devices
- Can automatically block calls based on user settings
- Requires "Phone" permission and "Call Screening" permission
- May not work on all device manufacturers due to OS customizations
iOS:
- Uses Apple's Call Directory Extension framework
- Labels calls only (cannot auto-block due to Apple restrictions)
- Requires manual enablement in Settings → Phone → Call Blocking & Identification
- Updates to call directory may take up to 24 hours to propagate
- Limited to 100,000 numbers per Call Directory Extension
Web:
- Real-time call screening and caller identification are not available on web
- Voicemail transcription is supported: web users can upload voicemail audio, view their transcriptions, and export them
- Spam statistics and reports are available
- Call recording and time-based blocking are not available on web
11.3 Data Sources and Accuracy
11.3.1 Community-Sourced Data
Our Caller ID Services rely primarily on community-reported data:
- User reviews and spam reports
- Feedback from post-call surveys
- Crowdsourced spam intelligence
- User-submitted call recordings and voicemail transcriptions
11.3.2 Third-Party Data
We may supplement community data with:
- Publicly available business directories
- Government databases (FTC Do Not Call Registry, etc.)
- Licensed telecommunications data
- Third-party spam databases
11.3.3 Accuracy Disclaimer
CALLER ID INFORMATION IS PROVIDED "AS IS" WITHOUT WARRANTY:
- Spam scores are probabilistic, not definitive
- False positives may occur (legitimate calls marked as spam)
- False negatives may occur (spam calls not detected)
- Business names may be outdated or incorrect
- Caller ID data may be spoofed by malicious actors
- Service accuracy depends on community participation
You acknowledge that:
- PhoneTea cannot guarantee 100% accuracy
- You are responsible for verifying important calls
- You may miss legitimate calls if using auto-blocking features
- We are not liable for blocked or mislabeled calls
11.4 User Responsibilities
11.4.1 Whitelist Management
You are responsible for:
- Maintaining your whitelist of safe numbers
- Regularly reviewing and updating your whitelist
- Ensuring important contacts are whitelisted
- Understanding that whitelisted numbers will never be blocked
11.4.2 Accurate Reporting
When using Caller ID Services, you agree to:
- Provide accurate and truthful spam reports
- Not abuse the reporting system for harassment or retaliation
- Report only calls you personally received
- Use appropriate labels (spam, telemarketer, robocall, etc.)
- Not submit false or misleading information
Prohibited Actions:
- Mass-reporting numbers without basis
- Reporting legitimate businesses as spam out of spite
- Coordinating with others to manipulate spam scores
- Using automated tools to submit false reports
- Reporting personal numbers to harass individuals
11.4.3 Legal Compliance
You acknowledge and agree to:
- Comply with all applicable call recording laws in your jurisdiction
- Obtain proper consent before recording calls where required
- Not use call recordings for illegal purposes
- Understand call recording legality varies by state/country
- Take full responsibility for your use of call recording features
Call Recording Laws:
- One-Party Consent States: You may record calls you participate in without notifying others (e.g., Alabama, Alaska, Arizona, Arkansas, Colorado, DC, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia, Wisconsin, Wyoming)
- Two-Party Consent States: You must notify all parties before recording (e.g., California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, New Hampshire, Oregon, Pennsylvania, Vermont, Washington)
- International: Laws vary significantly - research your local requirements

11.5 Call Recording and Voicemail Services
11.5.1 Recording Consent
By using call recording features, you represent and warrant that:
- You have obtained all necessary consents to record calls
- You will inform call participants of recording where required by law
- You understand penalties for illegal call recording in your jurisdiction
- You will not use recordings to violate others' privacy rights
11.5.2 Voicemail Transcription
Voicemail transcription services:
- Use automated speech-to-text technology
- May contain errors or inaccuracies
- Are not suitable for legal or medical transcription
- May not work with all languages or accents
- Require audio file upload to PhoneTea servers for processing
You acknowledge that:
- Transcriptions may contain sensitive information
- Automated transcription is not 100% accurate
- You are responsible for verifying important voicemail content
- We may retain voicemail audio and transcripts as described in our Privacy Policy
11.5.3 Storage and Retention
- Call recordings are stored locally on your device by default
- Cloud backup is optional and requires explicit consent
- Voicemail transcriptions are stored on PhoneTea servers
- We retain recordings/transcriptions for up to 90 days unless deleted sooner
- You can delete recordings/transcriptions at any time
- We may retain metadata (duration, timestamp, spam status) longer
11.6 Spam Detection and Blocking
11.6.1 Automated Blocking
If you enable automatic call blocking:
- Calls with spam scores ≥80% may be automatically blocked
- Whitelisted numbers are never blocked
- You can adjust blocking sensitivity in settings
- Emergency numbers (911, etc.) are never blocked
- You can view blocked call logs in the app
11.6.2 Blocking Risks
YOU ACKNOWLEDGE THE FOLLOWING RISKS:
- Important calls may be incorrectly blocked
- Business callbacks or delivery notifications may be missed
- Two-factor authentication calls may be blocked
- Medical or emergency callbacks could be affected
- Job interviews or recruitment calls might be blocked
MITIGATION:
- Regularly review blocked call logs
- Whitelist important numbers proactively
- Check voicemail frequently
- Disable auto-blocking for critical periods (job search, medical situations)
11.6.3 Time-Based Blocking
Time-based blocking features:
- Allow scheduling "Do Not Disturb" periods
- Block calls during specified hours (e.g., 10 PM - 8 AM)
- Emergency contacts can bypass time-based blocks
- You are responsible for configuring schedules correctly
- Misconfiguration may result in missed calls
11.7 Business Verification and Reverse Lookup
11.7.1 Business Name Display
Our reverse lookup service attempts to identify business callers:
- Business names are sourced from public databases and user reports
- Names may be outdated, incorrect, or incomplete
- Scammers may spoof legitimate business names
- We do not endorse or verify businesses displayed
- Business listings are for identification purposes only
11.7.2 Verified Business Badges
Businesses with "Verified Business" badges:
- Have undergone our verification process
- Provided documentation of business legitimacy
- Pay a verification fee to maintain status
- Are subject to ongoing monitoring and review
Verification does not guarantee:
- Quality of service or products
- Ethical business practices
- Compliance with consumer protection laws
- Absence of complaints or legal issues
PhoneTea is not responsible for the actions of verified businesses. Verification indicates identity confirmation only, not endorsement.
11.8 Privacy and Data Handling
11.8.1 Call Metadata Collection
When using Caller ID Services, we collect:
- Phone numbers of incoming calls
- Call duration and timestamps
- Your spam reports and labels
- Call outcomes (answered, blocked, missed)
- Geographic location of phone numbers
- Carrier information where available
This data is used to:
- Provide spam detection services
- Improve accuracy of Caller ID information
- Generate spam statistics and trends
- Comply with legal obligations
- Prevent abuse of the service
11.8.2 Data Sharing
We may share anonymized, aggregated Caller ID data:
- With other PhoneTea users (spam scores, business names)
- With researchers studying robocall trends
- With law enforcement investigating illegal robocalls
- With telecommunications regulators (FTC, FCC)
We will never sell individual call logs or personally identifiable call records to third parties.
11.8.3 Data Retention
- Active spam reports: Retained indefinitely for community benefit
- Call event metadata: Retained for 12 months
- Voicemail transcriptions: Retained for 90 days (user-deletable)
- Call recordings: Stored locally by default, cloud storage optional
- Blocked call logs: Retained for 30 days

11.9.1 Prohibited Uses
You may not use Caller ID Services to:
- Harass, threaten, or intimidate others
- Submit false spam reports maliciously
- Manipulate spam scores for competitive advantage
- Create fake business listings
- Scrape or export our spam database
- Reverse engineer our spam detection algorithms
- Automate mass reporting of numbers
- Interfere with emergency services
11.9.2 Penalties for Abuse
Violations may result in:
- Suspension of Caller ID Services
- Removal of your submitted spam reports
- Permanent ban from PhoneTea
- Legal action for damages
- Reporting to law enforcement if criminal activity is suspected
11.9.3 Dispute Resolution
If your number is incorrectly labeled as spam:
- You can claim the number through our verification process
- Provide evidence that you are the legitimate owner
- Submit documentation refuting spam reports
- We will review reports and may remove incorrect labels
- Resolution typically takes 3-5 business days
If you disagree with a caller ID label:

11.10 Service Availability and Changes
11.10.1 Service Interruptions
Caller ID Services may be temporarily unavailable due to:
- Maintenance or upgrades
- Platform API changes (Android, iOS)
- Database updates or migrations
- Force majeure events
- Legal or regulatory requirements
We will provide advance notice of planned maintenance when possible.
11.10.2 Feature Changes
We reserve the right to:
- Modify spam detection algorithms
- Change blocking thresholds or criteria
- Add or remove Caller ID features
- Limit usage for free vs. premium users
- Discontinue services with 30 days' notice
Premium users will receive priority notification of changes affecting their subscription benefits.
11.10.3 Premium Features
Certain Caller ID features may require a premium subscription:
- Advanced spam analytics
- Increased call recording storage
- Priority reverse lookup
- Custom blocking rules
- Ad-free experience
- Export call history reports

11.11 Liability and Disclaimers
11.11.1 No Warranty
CALLER ID SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of accuracy or completeness
- Warranties of merchantability or fitness for a particular purpose
- Warranties of uninterrupted or error-free service
- Warranties that spam detection will prevent all unwanted calls
11.11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHONETEA SHALL NOT BE LIABLE FOR:
- Missed calls due to incorrect spam blocking
- Damages from incorrectly labeled calls
- Business losses from call blocking or mislabeling
- Privacy violations by third-party callers
- Illegal call recording by users
- Data breaches affecting Caller ID information
- Service interruptions or downtime
- Inaccurate business information or reverse lookup results
OUR TOTAL LIABILITY FOR ALL CALLER ID SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PREMIUM SUBSCRIPTION (IF ANY) IN THE PAST 12 MONTHS, OR $50, WHICHEVER IS LESS.
11.11.3 Indemnification
You agree to indemnify and hold PhoneTea harmless from any claims arising from:
- Your illegal call recording activities
- Your false or malicious spam reports
- Your violation of call recording consent laws
- Your misuse of Caller ID information
- Your violation of others' privacy rights through our services

12. iOS Caller ID Specific Terms
12.1 Apple Requirements
Our iOS Caller ID features comply with Apple's Call Directory Extension guidelines:
- Cannot auto-block calls (iOS restriction)
- Can only provide identification labels
- Requires user enablement in iOS Settings
- Subject to Apple's App Store Review Guidelines
- May be limited by iOS system restrictions
12.2 iOS Data Sync
- Call Directory updates sync when the app is opened
- Manual sync available in Settings → iOS Caller ID
- Syncs up to 100,000 phone numbers
- Updates may take up to 24 hours to appear in iOS
- iOS may rate-limit update frequency
12.3 iOS Permissions
You must grant the following iOS permissions:
- Call Directory Extension access
- App Groups (for data sharing between app and extension)
- Local storage for Call Directory database
Revoking these permissions will disable iOS Caller ID features.
13. Android Caller ID Specific Terms
13.1 Android Requirements
Our Android Caller ID features require:
- Android 10 (API level 29) or higher
- Phone permission granted
- Default Phone app or compatible dialer
- Call Screening permission (Android 11+)
13.2 Device Compatibility
Caller ID may not work on:
- Heavily customized Android ROMs
- Devices that restrict background services
- OEM-modified phone apps (Samsung, Xiaomi, etc.)
- Devices in battery saver mode
- Devices without Google Play Services
13.3 Auto-Blocking
Android auto-blocking features:
- Require "Block Numbers" permission
- Use Android's CallScreeningService API
- Can automatically reject incoming spam calls
- May not work on dual-SIM devices
- May conflict with other call blocking apps
14. Changes to Caller ID Terms
We may update these Caller ID-specific terms:
- With 30 days' notice for material changes
- Immediately for legal or security reasons
- By posting updates on our website
- Via in-app notification for active users
Continued use of Caller ID Services after changes constitutes acceptance.
BY USING PHONETEA'S CALLER ID SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

15. AI Summary Feature
15.1 AI Summary Access
- Free users: 100 AI summaries per month
- Ad-Free users: 150 AI summaries per month
- Monthly Pro users: 600 AI summaries per month
- Yearly Pro users: 1,500 AI summaries per month
- Lifetime Pro users: 3,000 AI summaries per month
- AI summaries provide automated, algorithmic analysis of phone number
reviews and message threads (see Section 15.2 for how they are generated)
15.2 How AI Summaries Are Generated
- "AI summaries" are generated by an automated, rule-based algorithm
that aggregates and analyzes patterns in phone number reviews and
messages. They do not currently use large language models (LLMs)
or generative artificial intelligence.
- The "AI" name refers to the automated, algorithmic nature of the
feature. We may incorporate machine learning or LLM technology in the
future; if we do, this section will be updated.
- AI summaries are for informational purposes only
- Summaries are generated algorithmically and may not be 100% accurate
- We do not guarantee the completeness or accuracy of AI summaries
- Usage limits reset on the 1st of each month
16. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
17. Advertising
17.1 Ad Display
- Free users will see advertisements
- Premium users enjoy an ad-free experience
- We use Google AdMob for ad delivery
- Ads are subject to Google’s policies
17.2 Personalized Ads
- You may opt out of personalized advertising
- This setting can be changed in your profile
- Opting out does not remove ads entirely (free users)

- Accuracy of user-submitted content
- Accuracy of AI-generated summaries
- Uninterrupted service availability
- Freedom from errors or bugs
- Fitness for a particular purpose
- Availability of specific API endpoints
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHONETEA SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount paid for Services in the past 12 months
- Damages arising from user content or third-party services
- Damages arising from API access restrictions or terminations
- Business losses resulting from service modifications
21. Indemnification
You agree to indemnify and hold PhoneTea harmless from any claims, losses, or damages arising from:
- Your use of the Services

22. Dispute Resolution
22.1 Governing Law
These Terms are governed by the laws of the State of Michigan, United States.
22.2 Arbitration
Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association, except:
- Small claims court actions (under $10,000)
- Intellectual property disputes
- Emergency injunctive relief
22.3 Class Action Waiver
You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.
22.4 Dispute Resolution for API Enforcement
Disputes regarding API access enforcement decisions should first be addressed through our appeals process (Section 9.10). Arbitration is available only after exhausting the appeals process.
23. Changes to Terms
We may modify these Terms at any time. Changes will be effective:
- Immediately upon posting for non-material changes
- 30 days after posting for material changes
Your continued use of Services after the effective date constitutes acceptance of new Terms. We will notify Premium users of material changes via email.
24. Termination
24.1 By You
You may delete your account at any time through app settings.
24.2 By Us
We may terminate or suspend access immediately for:
- Terms violations
- Fraudulent activity
- Legal requirements
- Service discontinuation
24.3 Effect of Termination
Upon termination:
- Your right to use Services ends immediately
- Subscription benefits cease
- API keys are deactivated
- Content may be deleted (subject to legal requirements)
- Financial obligations remain
- No refunds for Lifetime subscriptions in cases of terms violations
24.4 Survival
The following sections survive termination: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.

25.1 Entire Agreement
These Terms constitute the entire agreement between you and PhoneTea.
25.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
25.3 No Waiver
Our failure to enforce any right does not waive that right.

You may not assign your rights. We may assign our rights to any successor.
25.5 Force Majeure
